    Roommate Eviction
    My husband & I are the only ones signed to our lease. We had a man move in October 1, 2011. Every month he has been late w/ his rent. Over the past two months he's had his girlfriend stay, which was only supposed to be 2 weeks. We've been dealing with their non-stop arguing, loud music & we found out they have been using drugs in our home. After the last straw of being extremely patient, we politely gave him his 30 day notice & advised him we were going to start looking for another roommate. We did not receive Febrary's rent check until the middle of the month, only to find out a week later it had bounced & we finally obtained the money the last few days of the month. It is now March 5th, he has not given us the rent check, he has not been home, only to grab some clothes. I am worried he will never pay us for this month & he might hurry & move his things out while we are gone. I have no idea what to do.

    You sent him the "30-day letter," right? Now file for eviction according to the laws of your State.

    So by evicting him do you think he will pay you for March? He sounds like a total deadbeat and you will likely need to write March off. When did you mail him the notice and what state are you?

    Do you have a lease with him? Since he is not on the lease for the property, YOU are his landlord and he is your tenant. Therefore you have to remove him subject to the laws where you live (ANY question on law needs to include your general locale as laws vary by area.).

    Notice to vacate needs to be written and does not have to be polite. If you did give written notice and the deadline has passed, then file for an eviction order. If you haven't given written notice, then give him a Pay or Quit notice. This gives x days (depending on location) to pay up or vacate. Then file for eviction

    Did you get a security deposit? That can be used to offset unpaid rental.

    Next time, understand that being a landlord is a business. You have to treat it that way. Screen your next roommate, have them sign a lease, get a security deposit.
