I know it is different from state to state... Anyone know if in Ohio you have to give any legal notice to "evict" an adult child from your house? There is no agreement, no rent, no nothing. Just DISRESPECT!

Yes, if they have established tenancy, you must noticy them in accordance with the law in your area, and move to evict them if they do not vacate once the notice period has expired.

Ok, but was I clear that they have not been a tenant by definition? They have never paid any rent nor been asked to. I was under the understading that a "tenant" is one who has a lawful rental agreement, lease, pay rent, etc.

Of course, I will give her a reasonabel amount of time to vacate, but do I need to do as if she were a paying tenant which would include filing, certifying an eviction notice?

This is just my adult child who has lived with me since birth and now needs to go!

Doesn't matter... you don't have to ever pay rent or be expected to, to be a tenant... just having lived there for longer than a visit is enough on its own. Yes you will have to treat them exactly as if they were renting the room off you.

- And why take the chance and waste another month wondering whether she is a tenant or not. File the papers. Move to evict her. I wouldn't argue tenant or not - I'd just start the legal procedure to throw her out.

But she DOES need to be evicted.

She is a resident and has residency right. You must evict just like any other person.
