Judgements and assets
I have a judgement against me and I am working to try to get a void judgement. However, in the meantime I need to know what to do if the company comes after my assets. I have direct deposit of civil service retirement, but no other bank accounts. This is a joint account with my husband. He has a separate account in his name only and I could send my check there. The only other asset I have is a vehicle that I co-signed on with my daughter. It is in her name, but I assume my name is on the title too since I co-signed with her for the loan. I have no other property but am really worried about the car because it really is my daughter's and is her only means of transportation and she has two small children. She still owes about $3000 on it and I don't know if we could pay it off right away? Can the creditor put a lien on this vehicle or make us sell it? We live in Texas. Are civil service retirements protected like social security? I know they can not garnish them, but I worry about what happens after it gets into the bank.

They can't take the car because the bank owns it. You're right, though. Once your money is in the account, they can't distinguish your SS from a gift your Aunt Tillie gave you. Given the above, they ARE going to get your money. Wouldn't you if you could? excon |
