Is there anything a parole's family can do to stop a po from constantly harassing the person ? Does a parole have civil rights to fight this po?

Hello l:

No. A parolee is a prisoner of the state living on the street at the pleasure of the parole board. His civil rights, therefore, are GREATLY curtailed.

That doesn't mean he has NONE, and the PO can do ANYTHING.. He can't... So, if you'd be a little more specific about what's going on. I'll see if I can help.

My son was charged with a hate crime which was subsequently dismissed by the Ca. superior court, but he still was held in Pelcan Bay for 10 months. He has never been given any credit off his parole time for this. On release, he immediately checked in with the parole office and was arrested and charged with impersonating a peace officer because he was wearing a sweat shirt that had a logo of a sheriff's department he got from a thrift shop. It was basically a shirt sold as a fundraiser for the dept. They sent him to Folsom without a trial. His whole experience with the po is criminal, and a total denial of HUMAN rights.

In the law, specificity is crucial. If I'm going to be able to help, I need to know exactly what has occurred. Off the top, you're saying the charge was dismissed BUT that he had some parole time... Those two things are incompatible.. If he has some parole, he WAS convicted of something... He had a lawyer for that hearing too. Certainly he SHOULD have been given credit for his good time, but it's not ALWAYS the case.. His lawyer at the time would have that answer... He won't speak to you, though. Your son needs to give him permission to speak with you.

As far as his violation for the tee shirt, he SHOULD have a violation hearing within 30 days. If that doesn't happen, he needs a NEW lawyer for that event.

Justice ain't cheap.

There are not trials, but there are hearings with the PO board about his violations. But he can be held in prison as a parole holding, pending a hearing.
