    Part year residency in two states
    Hi,

    I lived in NC for 9 days in January 2011 and have earned income there. I also own a home in NC and have a mortgage. I have lived in VA since then and have income there as well. But I don't own a home in VA and rent instead.

    I intend to file my state income tax returns as part-year resident at NC and a full-year resident at VA. I was wondering if I should file as a part-year resident in VA too. Could you please let me know your suggestions here? Also, I am married and plan to file a joint return with my spouse who is on H-4 visa and has no income.

    You can't be a full year resident of VA and part-year in NC. You need to file the NC return as a part-year for the 9 days of income and the remainder of the year should go on a part-year VA Return. NC uses the same form for both residents, non-residents and part-year. However, VA does not. It has a separate form for each type of filing. A part-year Virginia resident files Form 760PY.

    Actually, you CAN file the NC return as a NON-resident, then claim a tax creidt for the taxes paid to North Carolina on your Virginia return.
