    I am no expert on this subject, but I believe either her spouse, or her eldest child.

    Is it absolutely certain she left no will? If she has assets and accounts, I would think she does have a will somewhere.

    Since your mother died (intestate) there will have to be an administrator appointed to handle the estate. Laws vary by state on who can administer an intestate estate and how it should be distributed. Providing your location will help us to give you a more detailed answer.
