    Summons Received
    I received a summons from a debt collection agency stating that I am being sued for a credit card debt. However, there is no time to appear in court. It just says I have 30 days to respond. Just wondering what the routine for this is... I send in my response and then what happens? Is another summons delivered with the court date or what?

    Do not call or respond atall at this point. First tell us if this debt is a valid debt that you recall oweing, if so when was your last payment made or when did you last acknowledge the debt? The CC sold the debt to the collection company in all likelihood for pennies on the dollar. They can be tricky and devilish with their tactics trying to get you to make an offer. What state are you in?

    I am in GA.
    Yes, it is a valid debt. Last payment was about September 2010. The CC sold the debt to Midland. They have turned it over to a lawyer/collection agency in GA.

    I was served on the 8th of Feb. I have 30 days to answer. However, at this point, I really think I would do better to file bankruptcy. (I also have other debts.) So I am wondering if I will be able to file with this summons hanging out there and how that will affect the case. And if I do decide to file, how do I answer the summons?
