    Is there a separation law?
    I have been married for almost 23 yrs. We are currently separated. I live in Illinois with our 2 children, my husband in Indiana. We have different ideas about how to raise the kids among many other problems. He refused counseling when we were together. He has a very dominant personality and when I refused him something, he told me to leave. I have been away from him since June of 2005 and he basically told me last night that either we get back together as man and wife or he wants a divorce. The main reason we stayed together is because I needed his medical insurance. I have only a part time job (it does have benefits that the employee has to pay for) but I cannot afford them. I only get 20 hours a week of work but I really like my job. My questions are: Does after a certain amount of time of physical separation automatically say you are no longer married? And if he does divorce me, what could I do for medical benefits? I have a condition which requires medical attention every three months. My lawyer said that it is up to his employer's discretion if they were to keep me on his insurance. His employer said no they wouldn't. Any suggestions?

    As Talaniman suggested for the medical benefits question, please review the requirements on the link he supplied.

    In answer to your first question, no. Time and physical separation does not automatically say you are no longer married. In the U.S. you need to file for divorce to end a marriage.
