    Lease termination
    I Have been living in my rented home for 9 months, its peridoc tenancy, or month-to=month. Since I have been here for less than a year, am I obligated to give 60 days notice or is written 30 days notice sufficient?

    Do you have a written lease now or did you have one in the past? If so, does it specify how much notice needs to be given?

    If you never had a written lease and you are a month-to-month tenant then you should be able to terminate with 30 days written notice.

    This is the verbiage of my lease agreement. I don't quite understand it:
    If this agreement is a periodic tenancy, either party may terminate the tenancy by the service of at least 30 days written notice if the tenancy of any occupants is less than one year, or by the service by either party of at least 60 days written notice if the theancy of all occupants is one year or longer at the time of service.

    Does your lease have a start date and end date? Anything that says how long it will last? Or does it specifically say that it is a month-to-month tenancy?

    NO specifc end date at all just speicifies month to month, but to refer to paragragh (above) for terms of termination... I hope this makes sense.

    Yes, it makes sense. From what you've said here it sounds like you're required to give 30 days written notice if you want to terminate your tenancy.

    Your contract states you must provide a 30 day notice of intent to vacate if you have resided there 9 months as you stated. If you continue to live there for a period of 12 months or longer without giving a written notice to vacate then you are required to provide a 60 day written notice. Typically a 60 day notice is required to compensate for market conditions, length of time it will take to make the home ready for a new renter as well as what time of year the vacancy will fall. Most people do not move in the winter months, yet everyone (in Texas) decides to move for no reason or any reason. The landlord is attempting to lessen their exposure to lost rent.
