    OPT-H1 tax returns
    Hi,

I was on OPT till 7th August 2006. I worked on OPT till 15th July and then I started working on H1-B from OCT 1st. Which Tax returns form should I file? Do I come under non-resident alien or Dual-status alien for tax purposes?

    Thanks in advance.

If you want to wait, you can file as dual-status. However, it is likely NOT to make a difference tax-wise, so I recommend you file as a non-resident alien for 2006.

For 2007 and beyond, you will file as a resident alien.
