Illegal Transfer of Marital Domicile
Hello All!
As I have been reading through the comments, it is comforting to see so many knowledgeable answers. I certainly hope you can steer me in the right direction on the last of many issues that my Fiance' and I have been dealing with.
My "should be Husband" was only told by his "wife" that she squashed the divorce in 1995 that he thought was over and done with. To really shorten the story, the final blow came when he came to California and filed for divorce here after obtaining his residency status. His wife went to an Attorney where a notarized Quit Claim Deed was fraudulently signed and the home is now recorded in Suffolk County, NY solely as hers.
I had my Nevada Real Estate License, was an investor in many real estate project, but never have I seen someone do something so cruel. Being that we reside here and he does not have the funds to hire an Atty. I am stumped. Could someone be so kind as to advise me on how to have my Fiancée process?

Find the money for an attorney, divorce can be dirty, real dirty and this person sounds like they want to make his life hell.
A deed is easy to challenge in court, but honestly she is having attorneys, you will need an attorney

Yes get an attorney, file suit against the property under the statute of fraud, the Quick Deed Deed is fraudulent. File claim against the Notary who did it, most have to be bonded, your claim against there bond in the amount of the property.
File and record against the Quick Deed, Notice of Lis Pendens which will alert anyone of the pending suit against the property

My husband and I bought property together, I put in a large sum of money from a sale of property I owned before I married him, The property was in his name and we separated and he signed it over to his daughter, where do I stand legally in trying to get my money back that I put in to buy this property.

You want to know how your fiancé should proceed? As Yet and Excon told you, you really need an attorney. I don't think the California court, in the context of a divorce case, can decide title to the New York property, so you probably need a N.Y. attorney.
