Can this loser have the $186,000.00 back child support judgement I won in 2009 dismissed? He never paid a cent since I filed divorce in 1986. I went into hiding after the divorce was finalized in 88 and came out in 2008 when I read he broke his neck in a Work Comp accident. The judge ordered the three lawsuits he won be garnished and I geet $2,500 per month. The judge ordered all the child support proceedings be done via phone for me because I'm dying. He had to appear with his attorney. I did my case Pro Per. I got bankrupy papers today in the mail. HELP PLEASE?

Yes you could lose the judgement in a sense that if there is no money then you can't be paid. The child support isn't part of the bankruptcy with the exception that you are being listed as a debtor. It can not be dismissed by the bankruptcy court.

In another thread you wrote you were getting $1,500 per month. Which amount was he ordered to pay?

As Califdadof3 has indicated, child support is not dischargeable in bankruptcy and, since you have a garnishment order in place, the bankruptcy should not affect you. You should, however, consult with a bankruptcy attorney to make sure that you are protected.

My "dad" disappeared approximately 30 years ago after the courts ordered him to pay back child support or go to jail. I just found out, he is back in that state and purchased a home in 2003. What can be done at this time legally.
