    Removing co-signer
    My ex-husband is cosigner to my apartment and house, we are separeted for 9 years I would like to take cancel his consignemt don't know if I can since we are not divorsed yet. Will he have share.

    I moved your post to a new thread because you added your question to a thread that was 4 years old. This way more people will see it.

    A co-signer is someone who signs the mortgage loan to guarantee payment of the loan. The only ways a co-signer can be removed from the loan are if the lender agrees to let them out (very unlikely) or the property is refinanced.

    Also, is your ex-husband an owner of the property as well as a co-signer? If he's also an owner then he would have to sign a deed transferring all of his ownership interest in the property.

    Co-signer on what? Lease? Mortgage? Something else?

    You are either married and he is your husband OR you are legally separated and he is your husband OR you are divorced and he is your ex-husband. Which is he? Your divorce - if he is, in fact, your ex, would have addressed property issues.

    When you ask a legal question "we" need to know where you are in order to answer - laws vary.

    I have seldom seen it done, without a refi, in theory they could release the other person but why would they since it merely protects them more.

    So you will need to refi it, ( good time to with current rates anyway)

    This is assuming of course he is not on the deed, just a co-signer
