    I have a 5 year old son that lives with my ex girlfriend. The house they live in has a joint mortgage with both our names on. I want to be removed from this mortgage and may have to force the sale of the property via a court order. Is there anything my ex can do to stop this? Do I have any legal responsibilities to make sure she has a house for our son? I have my own home where my son could live but I want to know if I am legally obliged in any way to support her finacially other than through maintenance payments?

    First regarding the sale of the house - before answering we need to know whether you and your ex-GF are joint owners of the property. And if so, precisely how is the deed titled - is it "joint tenants with rights of survivorship," or is it "tenants in common?"

    Is there a court order in effect for maintenance support? Assuming that you have not fought for custody of the child, then your responsibility is to provide financial support for the child per the court order.
