    authorization for temporary guardianship of minor
    Hi,

    I live in South Florida, and a 5 months ago I sent my kids to live with her aunt in Atlanta Georgia temporarily due to Financial hardship I was having. We verbally agreed that when my situation got better she would give me my kids back without a problem. I thought she was just trying to help my kids.

    I signed a AUTHORIZATION FOR TEMPORARY GUARDIANSHIP OF MINOR form that the school requested, but I never signed any court papers, nor did it get notarized. Now that I want my kids back she refuses to give them back! She stated that the only way she will give me my kids back is with a court order. I cannot even find a form or petition that covers this matter.

    Other than look for the proper court forms, I have not tried anything. I am planning to take a trip to Atlanta and have the police escort me to her home so I can get my kids back. The aunt does not have a court order to withhold my children from me.

    My question is does she have any right to withhold my children from me? And can I go and demand that she turn them over to me? Please help me. Below is the form I signed

    AUTHORIZATION AND CONSENT OF PARENT(S) OR LEGAL GUARDIAN(S)
    1. I hereby declare that I have legal custody of the above named child.
    2. I hereby grant my full permission and consent for the temporary guardian to establish a place of residence for my child, and for my child to reside and travel with said temporary guardian.
    3. I hereby grant the temporary guardian my full authorization to make all decisions related to my child's educational, religious, and recreational activities and undertakings.
    4. I hereby grant the temporary guardian my full authorization to administer general first aid treatment for any minor injuries or illnesses experienced by the minor. If the injury or illness is life threatening or in need of emergency treatment, I authorize the temporary guardian to summon any and all professional emergency personnel to attend, transport, and treat the participant and to issue consent for any X-ray, anesthetic, blood transfusion, medication, or other medical diagnosis, treatment, or hospital care deemed advisable by, and to be rendered under the general supervision of, any licensed physician, surgeon, dentist, hospital, or other medical professional or institution duly licensed to practice in the state in which such treatment is to occur.

    Did you put an expiration date on the form ?

    Califdad asks a good question. But even if you did put an expiration date that is in the future, I believe that this guardianship is revocable at any time.

    I would type up a letter like this:
    Pursuant to the AUTHORIZATION FOR TEMPORARY GUARDIANSHIP OF MINOR executed by me on <insert date>, this document is to revoke that authorization with the intent for me to take full custody of my children (insert names>. Effective <insert the date you plan on picking up the children> the authorization issued on <insert date> is hereby revoked and <insert aunt's name> will no longer have any legal right to care for my children.

    Have that statement notarized and make a few copies with the notary applying the seal to each one. Then go to Atlanta with the copies and copies of your children's birth certificates. Go to the local police precinct where your aunt lives or where they go to school. Explain the situation and ask them to accompany you to pick up your children.

    Agree, serve the school with a copy and ask to pick your children up, This can be revolked at any time, So unless the aunt went to court and did anything, you should have no problem getting them back.
