    Mortgage problem
    2 1/2 years ago I requested a Mortgage Modification and for 2 years got the run around by BOA. I was lied to, harassed, told many different stories and never got the modification. I then found out that I was one of the many that CountryWide Mortagage had made the mistake of putting a company as my Mortgage holder that does not exist. Then BOA bought them out. I am told at this time legally, no one owns Mortgage rights to my house. BOA tried to forclose on me and I hired a Laywer to answer the Complaint and it was withdrawn by BOA. I now sit in my house, was told not to pay anything to BOA because doing so acknowledges that they are my Mortgage Company when they are not. I believe that this whole thing has been reported to the credit bureaus, destroying my credit rating. Is there anything I can do? Someone mentioned a Quiet Title Action to secure my deed. IS this an option and if so, can I do this on my own?

    I would never attempt to quiet title on my own - the stakes here are high. You need an Attorney.

    Isn't there a class action suit against Countrywide?

    I find this very hard to believe. Someone owns the mortgage, assuming you have not paid it off. Who told you that no one owns the mortgage? You had best keep making payments, or at least putting the payments into an account.

    My first lawyer just told me today to call another lawyer which I did, he said that I own my house but that at this time don't have a mortgage company since the one listed on my mortgage doesn't legally exist. I was told absolutely not to pay anything to BOA because they are not listed as my mortgage company and paying them would look like they were. This is a real headache.


    Yes, but at the time BOA was trying to forclose on me, my lawyer said that he did not want to put me in the class action suit. He wanted to do it separately and was successful in getting BOA to drop the Complaint.
    I am going to talk to a new RE lawyer next week that I just got a referral for to see what he thinks.
