My son was given a $100.00 on his 8th birthday from his father(my x) and told that he would not see him anymore. It has been 7 years since he has contacted my son. He has not paid child support either. Last week he called my son and asked to meet him at the local skate park. Upon the meeting my x gave our son a new bike. An expensive bike. The State of Oregon wants me to allow them to pursue my x for back child support and execute the laws for his non payment. My concern is my son, who wants his father to just go away as he has a wonderful relationship with my husband his step father. Does my son have any legal rights to not see his father?

Child support and visitation are two separte things, if he does not want to see his bio father, why did he "meet" him in a park, and for heavens sake why did you allow it,

Visitation can not be forced on the child, and it is not the issue of his right over the right of the bio father, Paying or not paying support makes no difference, if there ever was a court ordered visit plan written it is still in force if you have not went to court to change or modify it.

Next since it has been so many years, if the bio father wanted to start visits, you could ask the court to make it supervised, to require counseling and so on.

Why do you think after 7 years the father will want visits now ?

Also if the child wants the father to go away, why did he not tell him that instead of meeting him at a park,

But as noted before, child support and visits have nothing to do with each other and of course you should allow them to go after the support, I have to wonder why you have not all these years.
