Someone is staying with me in my home. Can I make him leave
He is not paying any bills and is not contributing to the household at all.

It depends on what state you live in and what stipulations apply. In CO you can, especially if they are not on the mortgage or lease. But in CT, if someone has been staying with you for longer than 72 hours you cannot kick them out for any reason, in other states you might have to get a written notice or a legal eviction notice. I would call your local police department and ask them what your states guidelines are, they would much rather answer your questions over the phone instead of during a disturbance visit!

Svazloya, that is really interesting information. We often get questions of a similar nature, as to how to go about getting rid of an unwanted guest that has stayed far longer than expected. For some it has turned more into a permanent arrangement and causes people a lot of heartache.

Do you have a source for your specific information on different States?

    Thanks if you do.

In general, if someone has established residency (i.e. they receive mail at the address, have identification that shows that address, have all their belongings there, etc.), then they are afforded the same rights as a paying tenant. This means they have to be removed according to the eviction process for the area. This process starts with a written notice (usually 30 days) to vacate. If this notice is ignored, then you file for an eviction order in the local housing court.

First, I do not recommend calling the local police about this. Police handle criminal matters, not civil. Also police depts are not the most knowledgeable sources of law. It would be better to contact the local Dept of Housing, or Housing courts. Generally this is handled on a county or state level.

I'm also interested in your sources about CO and CT. This is a frequently asked question and we want to make sure we give an accurate answer.

Also, to the OP, how did they come to live in your home. Where they invited ? Were they suppose to pay rent, where they a boyfriend or girlfriend where the relationship has went bad.

Next how long have they been there, it sounds like more than a few days ?

Have you just asked them to leave yet ?
