Child comes with lice on head mostly all the time. Can I take that to court?
I've been trying to rid my daughter of lice from her head, but she comes back with lice. Can I take that to court as a reason that mother is unfit as a parent?

You can, but you may lose. From what we hear most social services and family court judges are aware that lice are an epidemic and don't feel that it should prevent visitation or shared custody. You should document all your related expenses, however, if it will help or at least get some reimbursement. But even that might not work, if your spouse has the same expenses.

It may not be the mother's fault. Have you reported it to the child's school?
It is highly unlikely that a court or social services will find a parent unfit over this.

Child custody
Can I be the custodial parent with the fact that I work hard and mother hasn't worked in years and just getting fat off government aid and child support. She has five kids and one of them is mine, the oldest one the grand mother keep ed from her own mother. Do I have a chance?

Can mom claim taxes
Can the mother claim taxes even if she doesn't work and claims child support? I'm recently going to court for that matter, mom is taking me to court cause I claim my daughter last year when she didn't work and I know that she didn't cause she didn't report any source of income to child support services. Did I do right or wrong?

You may need to explain you and your child's living arrangements a bit more.
I gathered that you and the child live with your mother and that is why your mother claimed her as a dependent.
But you also claimed the child , is this correct?
The experts that can answer you will probably need this information to be as clear as possible in order to answer you.

She is taking you to court because you claimed your daughter as a deduction? How does you ex know what you claimed on your tax return?
Do you have the child more than 50% of the time and are you providing a majority of her support? Does the divorce decree say who can claim her as a deduction?

Child tax claim
The visitation arrangements is 50/50 percent joint custody, but the mother is the custodial parent. I get our daughter every Friday at 4:30pm to Tuesday morning at 8:30am during school and Friday 4:30pm to Monday 9:00pm during summer. I do provide majority of the support being child support and the support I give her when daughter is in my custody. The mother hasn't reported any kind of income for about 6 years, and when we got devorced the judge said we can claim our daughter as dependent one year me and one year the mother. I was doing so until I noticed the mother wasn't working and that purhaps she was letting some of her sisters or cousins claim my daughter as a dependent in return for some cash. I have no proof of this, I tried to find out from the IRS but didn't get any information. The mother is now going to take me to court for this matter that I claimed our daughter on her year. My thing is why would mother try to claim daughter if she did not report to child support services that she was working and maybe my child support amount would get reduced?

Please keep all your related questions in one thread. There are several threads you have posted to today with related questions. This is confusing for those of us who are trying to help you and is likely to result in inconsistent answers for you.
Again, I am puzzled as to how you know about what tax return she may or may not have filed. The same goes for her information about your returns.
I suggest you engage in aggressive discovery, requesting production of her tax returns, papers she has filed with child support servces, and information on her income. Only after you have done that will you have a complete picture.

You need to present your evidence to the court and the judge will determine if you are a better choice to raise the child. You will need the help of an attorney to properly accomplish this though.

Custodial parent
Is there anyway I could win this case? I share custody with the other parent and I been paying child support for six years and paid off all my arrears I owed. I also pay medical expenses and share our daughter 50% percent of the visitation. Pertty much I don't need the mother's help with any expenses for our daughter just for her to see her in the weekends if the mother would like. I believe my daughter would be better off spending more of her time with me than the mother. It seems to me that the mother just doesn't have time for our daughter being the fact that she has to take care of four children on her own. I am married and have a wonderful wife. I am employed and the mother hasn't reported any income since we split up. Every year the mother moves from one county to another and it's very difficult for me and my daughter to keep up with mother's activities.

Child support
I recently went to court to a DCS meeting with the other party. The Child Support Agency wanted to lower my child support payment but the other party disagreed, she said that I don't pay child care expenses, that when I have our daughter is in the weekends, and she claims that I don't work on those days, and the weekdays that I have her, our daughter is in school. Now she is asking for proof, do I need to show proof of my work schedule and proof of payments to my child care provider even if I pay in cash?

Yes and yes - in NY. I have no idea where you are.
The Court is not going to award reimbursement or order partial payments without proof.

You need proof of the hours your worked (the hours you needed child care) and proof you paid for child care (and what hours were involved).
