Can I get an ex parte order in this case?
My ex and I share joint legal and physical custody; with him listed as primary custodial parent. However, he is military, and the kids have informed me that he has been gone for ten weeks and will be gone for a year... He never notified me of his leaving or his planned date of return, and he refuses to respond to any questioning. Can I get an ex parte order in this case to ensure proper placement of the children?

He left them with his new wife; but she is not included in the original order; and, he is supposed to notify me of any changes. The original order sinply states that he and I share joint legal and physical custody.

Then you have him cited for contempt of court and request a change of custody.
