    When do you file child abandonment in ga?
    So my son's father is in the military and has not sent anything for his child in 4 months. I reside in atlanta and he resides in fort polk,la can I file child abandonment?

    You may file for abandonment in Georgia if you have court ordered child support, GA is your resident and that of the child.

    Of course why are you not just having the money garnished from the check, that is much easier, file to get a order of garnishment on his pay for the court ordered child support.

    He was putting himself on child support in fort polk but haven't yet to send his part of the info over because by law in Lousiana if he doesn't have an order established he doesn't have to support our son all and they couldn't go back in the arreas under no circumstances so because he know he doesn't have to support our son without an order he is not going to send his paperwork in. So do I need to just file for child support in Ga? And will they be able to go in the arrears?

    Contact his Commanding Officer.

    The military looks VERY poorly on servicemembers that don't pay child support.

    If the military knows he has a dependent child, his checks WILL get garnished.

    If they have lived ( mother and child) in Georgia to est residence ( think it is 6 months) they can file in Georgia for support, ( not they are not allowed back support, just from the date they file)

    If they have not filed for support ( even filed in LA) then he owes nothing, so he is not behind and it is not abandonment by GA law.

    You should ask for support, and to be covered under his medical insurance, and also additional for day care. It is common to have the insurance and day care added on top of child support.
