I have three children with my ex,when I filed for divorce I petition the cout for joint custody, because I had no intention of keeping the father out of my children's life. However he has not had anything to do with my childern on reg basis. He comes in and out of their life about every four or five yrs. This time it has been five. Two of my children lived with him for about a month and a half five years ago.I picked them up to spend spring break with me and he never showed to pick them up.The stepmother call the school they were attending and said she was out of town if the kids should show up they will not have a place to go.I had to go with the police to get my children's things and it turns out she was not out of town. With that, I know long story, how hard would it be for me to get full custody or banish his parental rights?I want his rights taken away if that's an option. We live in Texas.

You can petition to get full custody but you cannot just strip him of his parental rights. Do you have a child support order in place and does he pay his monthly child support?

You can not take his rights away,

    You can
    1. make a motion to modify the custody agreement giving you primary physical and legal custody.
    * a. if he wants any visits he will have to add a motion for that to be added.

    2. make a motion to modify the current child support agreement ( assuming there is one) to reflect the current custody arrangement
*a. get a child support order if there is not one
