    Away for 5 months in 2006 - H1 Tax issue
    HI,

    I have been on a H1-B visa since Oct 05. During 2006 I was in India on work from the end of May until the 13th or so of October. What tax form do I need to file for this year?

    What was your visa status throughout 2006?

    I am single... was on H1 through 2006
    I think I qualify as a resident this year... not sure. If a resident can I claim the deductions of 3200 and 5100?

    Yes, you qualify as a resident alien. Your visit to India is irrelevant to the visa status.

    Yes, you CAN claim the deductions of $3,300 and $5,150.

    So what forms do I need to file for Federal?
    Also, I have been in NYC since I started working... What form for state tax this yr since I am a resident alien?

    For NY, IT-201,

    For federal, Form 1040, 1040A or 1040EZ.
