Once the executor has been duly processed (notarized forms from other heirs etc), then that person can open an estate account and withdraw funds as needed. This assumes no bank trustee. If the other heirs don't like it, they have to sue.

The executor of an estate has a fiduciary responsibility. They can use funds in the estate accounts for any purpose relating to the estate. They will however, need to provide a full accounting of what they used estate funds for.
