Travel/relocation expense deduction
Hi,
I am from india on F-1 visa status. I have question regarding travel/relocation expenses. Actually I moved form ND to MN (200 miles) on 18th may 2006 (jobs starts from 22nd may 2006) and I worked over their until 7th jan 2007 then I took leave(unpaid just) form their meanwhile I have another job option so I
Send a resignation letter to my company on 28th jan.
I just wanted to ask you I am eligible for travel/relocation expense deduction. Based on the time test I was not worked over their for 39 weeks but year end and jobs also ends.
I spend lots of $ during that move, at least I can get back some of them
One more thing I also have my wife IITN no(but she is not working no us based or India based income) so which status I can file married filled jointly or single. Which one is profitable... I suppose if I filled joint then I didn't get deduction for her.
Help Me Please.

The 39-week rule does not apply if you lose the job. Claim the moving expenses regardless of whether you file as a non-resident alien or jointly with your wife.
It is likely you would benefit the most if you filed jointly with your wife. However, you must be H-1 or H-1B at least part of the time in 2006.

Thanks for you reply but my job is just a internship (approx 7.5 months... ) they wanted me to continue as student but I got the fulltime job so I left that position and joines new job at different location and told the prvious company that I got the another job. Still you think I can eligible for travel/relocation deduction.

Yes, I still think you can take the moving expense deduction using Form 3903.
HOW you lost the job is irrelevant.

My status in US changed from F1 to H1B in mid Nov 2004. I was on F1 from Sep 2002-Nov 2004.
Will I be able to take the standard deduction ? If so will it be under the US-India treaty?
