    Do I have any rights as a mother
    My son moved to Kentuky with his dad about two years ago, when he moved down there we never changed our custody agrement partly because I was dumb and believed that when I was told he would be brought back once a month for visits he actually would be and partly because they left with two days notice. This past year I saw my son for one day on easter, they did not come up for christmas and I found out they were in Ohio 5 miles from my house on thanksgiving however told me that they were not coming up for thanksgiving. I have heard of numerous other times they have been 5 miles away and not even allowed him to call us or visit as well. My original papers state that we must agree on holidays or take it back to court so I am sure as far as the holidys unless I take them back to court Ihave no standing however it is summer now and in my original paper state that I am to get him every other weekend and 6 weeks in the summer starting the full week after he gets out of school. He is 17 years old now and he will turn 18 on July 27th of this year , I fear that the reason they have not brought him so far is due to him turning 18 while I would have have however the excuse I got was that his dad will have to have back surgery so they would not be able to make the trip up here. My brother in law's mother lives 15 miles from them in Kentucky and he just told me that he is going down there this weekend so I thought I would contact them and let them know I have found a way to get him up here. My response from them was that he might want to get a job this summer so they don't know, and the other excuse was that his dad told him that if he don't want to come up he don't want to and that he wants to spend the summer with his girlfriend. I told them that I would believe it when I hear it from him to have him call and this I going on two days now and they have not had him call today same excuse and no call. When I had my son over the day around easter he told me, my husband, his dad's father(his grandfather), and my sister and brother in law as well as me that he was afraid that he would not be aloud to come up at all this summer because his dad and step mother know that he might want to stay in Ohio after he turns 18. I also would like to add that in my a friend of his made him a Facebook account and I was talking to him on a daily basis until his step mother found out about it(ended up being around 2 weeks)and then have not heard from him at all since.


    Please help me asap, do I have any rights at all as mother here. I don't want to force him here , which is why I want to talk to him directly however I have a feeling this I not what he wants.

    You left out some very important info here. You said you never changed the custody agreement, but you never said what it was. Was the father the custodial parent or were you. If the custody agreement provided you with scheduled visitation and the custodial parent is not adhering to that order take him to court! If he moved making the visitation order impossible to adhere to and you or the court didn't give permission for that move, he is in contempt of court.

    You need to take him to court to enforce whatever court order is in place and you need to do that immediately. You should have never let him move without going to court.

    If your son is 18 now, then he is free to do whatever he wants about visiting you.
