    Pre-Divorce arrangements
    If my spouce files for divorce, do "I" have to move out of our house if my spouce says I have to. Who keeps the children while the divorce is pending?

    You don't have to do anything your husbands says. If your name is on the house guess what, he can't make you do squat. Until the judge orders custody you both are responsible. Talk to a lawyer for your own protection.

    Lawyer. Quick. You need to know a lot more about this topic for your own protection, if for nothing more than one good initial consultation about all the ins and outs of divorce.

    Before EITHER of you files for divorce, you should consult an attorney. Distribution of assets, custody, visitation, etc. are all a matter of negotiation. Generally a court will initially give custody to the mother and let them stay in the home until a final disposition can be noegotiated.
