Hi, my boyfriend is recently going through the family court to try and get to see his kids. However the mother of the children who has taken the kids to tasmania wants him to have no contact. I would like to know is it fair that a court sides with a mother on these issues, as they the court have agreed to no contact, and if he wants to continue fighting for them then he has to go to Tasmania to do this. Is this allowed and is there anything else he can do?

It appears she had to get as far away as she could and there must be a very good reason why the court agreed to no contact, sounds like there was a lot of violence involved. What do you mean 'allowed'?
Of course its allowed if that is what was decided.
Now tell us the whole story because there is obviously history behind this decision.

Second, have you seen the court rulings or were you in court? Or are you just taking your boyfriend's word on what happened?

If this is a court outside of Tasmania, they may have no jurisdiction, so they might not have "agreed" to no contact, but simply said they couldn't do anything about it unless she returned to the court's jurisdiction. If that's the case, then he would need to go to Tasmania to seek legal redress, or, at least, retain a Tasmanian attorney.
