    Need to know evection laws in S.C.
    I need to know the laws in South Carolina about evection. How many days do I have after being served with evection papers do I have BY S.C. LAW, do I have until I have to leave my home?

    Hello wendy:

    It depends on what type of eviction papers you're talking about. If it's a writ of execution, that's one of the papers served LAST. IF that's what it is, the sheriff should be watching you carry your stuff to the curb.

    However, IF it's a summons, then there needs to be a court proceeding first. IF your landlord is efficient, he might be able to have you out in 10 days on the short end, and if he's not efficient, you may be able to stay a month.

    There are links to state law sites at the top of this forum. But as excon said, the papers you receive (or will receive) detail what you have to deal with. If you haven't had a hearing yet, then one has to occur before the final papers can be issued. Once the final papers are issued it up to the landlord to give you time or just send a sheriff to turn you and your belongings onto the street.
