    New Jersey spouce not on deed?
    Husband owned the home prior to the marriage, it is now being refinanced the wife is not on the deed is it necessary for the state of New Jersey for the wife to be on this deed, she is signing the mortgage note and the itemization of refinance

    No, it's not necessary for the wife's name to be on the deed, even if she co-signs the note. The husband will have to be on the mortgage as well (since the property is collateral against the mortgage the owner must agree to the loan). And if the wife is prudent she should insist on being on the deed - because in case they separate and she moves out she will still be repsonsible for the mortgage.

    Unless the lender would require it as terms of the loan.
