    I assume you mean your wife.

    What state and country do you live in now. Laws vary. Some like NY would not permit it if she wanted to maintain custody.

    Does "still married" mean you are in the process of divorcing?

    And Smoothy, as usual, is 100% correct. NY recently heard a case where the wife moved with the children. Her husband brought a Motion to return the children. They not only were returned but the wife was stripped of her custodial rights. She now gets visitation and the husband has custody.
