    Hi everyone,

    Please help help. I was once charged shoplifting under $200. Paid all fees, services, diversion program, the case was expunged. More than stupid I once again is charged shoplifting of $50 in different county. My questions are:
    If I have an attorney, does the judge let me do the diversion program again plus all fees, community services hours or what will happen to me this time... I couldn't sleep for few days since my horrible mistake. Please help asap

    If the program is a "first offender program" then no, you already had the "first" time. If they offer this as a plea agreement, then you can do it.
    But normally first the diversion is for first offenders so don't expect it a second time
