    My 3 year old daughter
    My daughter is 3 years old and lives with her mother, she and I were never married. Her mother swears at her and in front of her, she hits her and she has a very short temper. I usually find out by my friends that her mother goes to clubs on certain days of the week and leaves my child with my mother. I pay maintenance and extra. It seems as if my child is frightened of her mother and when I have my child every second weekend and I have to take her back to her mother, she cries hysterically. I would like to know what I can do get custody of my daughter?

    That is too bad. Then there is physical abuse in the home and that is going to go against your ex. How do you know though, that she hits and swears at your daughter? Do you have eye witnesses that can come forward at a hearing to substantiate your claims?

    Your mother vcould be a witness I assume ?

    You need to go back to court and get this rectified, but you have to have absolute proof this is happening.

    Does the child have bruises ? Have you reported thus abuse to children and family services, who are the witnesses that the child is hit, will they testify in court ?

    But you file for custody of the child and use the evidence you have in court to prove your case

    Its fine coming on here and accusing, but if OP has the child part time, then he should be seeing the bruises. But it sounds like he is saying 'heresay'.

    The telling evidence is bruises on the three year old's body; this is horrendous. She is still a baby. This is serious accusations and child welfare should be informed even BEFORE coming here and saying 'WHAT SHOULD I DO'.

    I am appalled, as I am sure a lot of members would be from this thread.
