    Fed Tax- Nonresident spouse of resident alien filing jointly - attaching statement
    My wife is on F-1(NRA) and I am an RA for tax purposes and I have been filing married jointly for the last 2 years ( 2009 and 2010). I understand that my wife can be treated as RA for tax purposes because of my status and we can file jointly. But I forgot to attach a written statement with my 2009 return stating that we are making such an election. I wasn't sure if I should have done it with 2010 at least. Any help on what to do from here? Should I file an amended return for 2009 and 2010?

    Do not worry about the statement, and no amendment is needed. Her resident status is implied by the fact that she filed jointly with you.
