    After the tenants 30 days are up can I get a sheriff to make them go?
    The tenants were given a 3 day, then a 30 day. When there time is up can we get a sheriff to make them move, and how would we go about doing that?

    After you've given the tenants a written notice, if they fail to move out then you have to file a lawsuit for eviction. The court will set a date for trial and after you win a judgment you can have the sheriff perform an eviction.

    First, ANY question on law needs to include your general locale as laws vary by area.

    The sheriff will only act on a court order. Why did you not go to court after the 3 day expired?

    Eviction of tenants cont.
    We gave them a 3 day, filed court papers and the superior court clerk gave us the wrong date to appear before the judge. Therefor no one won, except the tenants we are evicting say they won. We looked up rcw laws, wrote out a 30 day notice, they signed it along with witnesses. Now can the sheriffs move them out on the basis of what the 30 day notice says?

    Didn't you read what I answered? A sheriff will only act on a court order.

    What were the grounds for the 3 day? Usually it's a pay or quit notice. This means they are in arrears and have to pay up or vacate. Though in some areas it can also mean a breach of the lease that must be repaired in the allotted time. If they haven't repaired the problem, you should be able to refile for an eviction if you missed the court date.

    In any case, you have to get an eviction order from the court before the sheriff will act.
