    What to do to get Soul Custody of my daughter?
    My daughters father is on child support and I haven't had problems on him not paying it,I never wanted him on it in the first place and I did the mistake of putting his last name on her.The problem here is that he lives in Dallas TX and I live in San Antonio Tx and he does not call to check up on her not even on her birthday or holidays to wish her the best! The same year she was born (2008)he got a 16 yr old pregnant while he was 20+ yrs ,the last time he saw her was in September of 2010 and that's because I paid for the bus ticket to take her to see him! Ever since I haven't heard from him,another thing is last month I received my daughters new insurance card from his job and it had a different girl I'm guessing his girlfriend that is pregnant on there he has babies everywhere!! That's ridiculous 3 "baby mamas" and he can't even be there for them child support is not enough!what about love, care, and being there for them, I just want soul custody of my daughter so that way I won't have to deal with him and I can make decisions on my own concerning my daughter with out his consent how do I do that??

    The likelihood of you getting SOLE custody is slim. Especially if he is paying support.

    You might have trouble getting sole custody of the soul, so go for custody of the body instead.

    It is sole, not soul ( God gets the soul) But the issue is you did not make a mistake he could have took you to court to have his rights. But merely not contact is not a reason to take his rights away, and even if he did not pay, but since he pays, you will not get any of his rights taken away.

    You won't get sole custody if by that you mean no visitation.

    First, please use the Answer options at the bottom of the page for follow-up questions or info. No need to post a comment for each response.

    You should have mentioned that you have a husband wanting to adopt. That does make a difference. The thing is the father will still need to agree to the adoption. If he won't then the adoption won't happen.

    However, the adoption will end his child support obligation, so he may be willing to relinquish to allow the adoption.
