    What is the penalty?
    My boyfriend lives in Tn with me. His Ex-wife lives in Florida with their son. She will not let them talk on the phone every time she gets a little mad about something. He pays his child support every week. If she were to pull that in TN, she would go to jail for 2 weeks and pay fines. What is the penalty in Florida for interference of visitation (phone calls/communication)?

    Where was the Order issued that permits him to have contact, what are the terms of the contact?

    Child support and contact with the child are two different things.

    He would go back to Florida (if that's where the Order was issued) and ask that she be held in contempt IF she is in contempt of a Court Order. If it's a vague Order she is not in contempt.

    It was all done in Flo. In the papers it states that she MUST allow no less then 2 calls per week and that she can't sabotage the calls... Thank you so much for answering my question.

    Then he goes back to Florida and files to hold her in contempt of Court. And, yes, she's in contempt. My advice to you? Document, document, document. If he can, have him call on a cell phone so the number of minutes he's on the line is recorded.

    If not, it's her word against his.

    As noted, Florida has jurisdiction. So any action against her has to be brought in FL. This doesn't mean he has to go to FL, a telephone court appearance may be allowed. But he should retain a FL attorney to petition the court for a contempt citation.

    Agreed, even n TN he would have to take her back to court.
