    Third degree theft charges for waiting
    One of my friend went to club last week and met one girl she was dancing and He talked to her and all that tried to flirt after 10 minutes she said she wants to go to bathroom and told him to hold on to her stuff he said OK her stuff is like her phone her purse and a jacket, He went to hang around with his friends in another area of the club He came back waiting for her she's not coming out He stayed there by the bathroom for like 45 minutes then He went outside the club she was standing with security guards and she pointed at him  said that's the guy who stole my credit card, phone and all the stuff, he was like sir she's drunk and she told me to hold her stuff. They didn't listen to him they called the cops and he took him to the precent and locked him in the cell and said they just going to give you summons and let you go, and after 36 hours his brother bailed him out for $3000.
    He is on 3rd degree theft charges 
    What will happen to him is he facing jail again? Give any good decision?

    Is the credit card incident the same as this incident?

    When he LEFT the club (went outside) where was her "stuff"? Concealed? Carried in plain view? Turned over to a club employee?

    He was waiting for her inside the club and he came out to look for her.

    If he left the Club with her "stuff" he can be arrested for theft.

    But he didn't open her bag or anything he gave it back just like that and he went out the club to look for her.

    You asked if he could be found guilty. Yes, he could. If so, could he go to jail? Yes, he could.

    Explain the facts as you know them to the Judge.

    You ask if he could go to jail.. If he's found guilty, sure. But, you say he isn't guilty. That's fine. I'm not here to judge. He needs a good lawyer to advise him.

    He needs a good attorney, you said, go to jail "again" so he has been convicted before, if so, what for ?

    But he should have stopped walking around looking for her and do what anyone else would do, give it to employee at the club and never ever walk outside with it.

    Also? Sorry, but a girl who did not take her purse to the bathroom with her ( sorry I don't think you will even find a person who will believe it)

    So hire the best lawyer you can afford

    This is the key point. The girl came back and he wasn't where she left him. So it's a natural assumption that he stole her stuff.

    Did he ask anyone to go into the bathroom and see if she was in there?

    When she didn't come out HE should have gone to security and told them he was watching these things for a girl and she disappeared. But instead he made the mistake of leaving the club.
