    Are gas stations considered private property?
    I was recently arrested for hitting a gas pump at a gas station and am currently a habitual traffic offender therefore I should not have been driving; however is it legal for me to get arrested from the premises being as though it is considered private property? Do I have a case as far as fighting the ticket due to it being in the parking lot of a gas station?

    The laws vary by state, but in general traffic laws are enforced on private property if the general driving public has the right to drive there. So places like shopping mall parking lots and gas stations are included, whereas privately-owned and maintained roads in a gated community where the general public is not allowed may not be. However, even if driving on true private property you can still be cited for certain offenses such as DUI or causing damage to property.
