    Temporary restraning order
    Hello, I am newbie here and I want to know if I was served an temporary restraning order by the Sheriff. A couple days ago, I heard a doorbell rang along with heavy doorknocking about 15 min. Looked through the front door, I saw a strange man standing outside . He tried to knock the door again. I don't know who is he and let him alone. Half an hour later, I brought the trash container outside to the street and walked to the front door . I saw some paper left in front of the door then picked it up and brought inside the house to see. There was a temporary restraning order against me from my ex-family signed by county jugde the day before. The next morning when I took the kids to the shoolbus, I saw a little card taped on the frontdoor window of my van, the card from the county sheriff instructed me to call them at the given phone number. I did call them and was told they needed to serve me an court order , I did make an appointment with them tomorrow but tonight , I did hear another door bell rang with the rooaaming by neighbor's dogs every 30 min. Have I been served properly? Thanks.

    I don't know, but I don't see what difference it makes. It's proper today, or it's going to be proper tomorrow. If you really want to know today, go by your ex's house and see if you get busted. If you do, then you dun been served proper.

    As excon said what does it matter. The Restraining order bars you from doing something with respect to your ex family. If you are caught violating the order, lack of proper service may not save you. Your calls and the testimony of the person who left the order may be enough to show you were aware of it.

    I guess so. Thanks for confirming. I know my ex-family lie to get me out of the house. The thing is I need a little more time to prepare until the hearing on 02/07/07. Since my-ex declare her income $3,000.00/month but I know for sure she get at least $6,500.00/month and I do get some copy of the deposit receipts from her bank along with some bank monthly statements. How can I prove her made a false statement in front of the court. Thanks in advance.

    Your preparation for court has little to do with the restraining order. The order probably states that you are not allowed to go near any of the family and/or contact them in any way. READ the order for the specifics.

    Now, as to proof of income, your atty should be filing a discovery motion to subpeona pay stubs or tax data.

    Since you know what a "restraining order" means, I would not make any attempts to go over there and "see if you get busted". I would leave it alone and go to the court date. Everyone gets a chance to tell their side in court and that's what you should do. At that time you can bring up the issue on whether you have been served properly. But seeing as you show up in court on the set date, that would show you were notified properly.
