    What form to use to file Income tax
    We filed taxes through 2008. My husband got very ill and was unable to work. From that point until July 2010 when my husband died, we only got his SS check and I had some money in a trust that is now used up. Probably brought in 25,000 all included in 2009 and 10,000 less in 2010. What form should I file? I received a K something from atty. To "attach" to my paperwork. He handled trust which is now closed but never handled taxes. My husband had some guy do it for $400 but when husband got ill, I had no $ and that was that. Am I going to be in a lot of trouble for not filing in 2009? What should I do or what forms to use and where to get them. Help!

    Your case is not all that extreme. I once had a client who had not filed for FOURTEEN years when he contacted me to bring him up to date.

    You definitely need to file the return, but, based on the information provided, you probably have little, if any, tax liability.

    If you do owe taxes, you can ask for a waiver of the penalties by simply explaining to the IRS what happened.
