You pay your back support in full. You can also go back to the Court that issued the lien/order, prove it's a hardship and ask that the lien be removed.

Sometimes it happens, sometimes it doesn't.

Weren't you advised that you were in arrears and action would be taken?

Go to the Court that issued the Order - and your bank will give you the info - and ask to look at the file. You have to be served in order for someone to get a Judgment against you.

If the affidavit of service is incorrect, petition the Court for a rehearing.

It's a shame you didn't pay your child support. Now you are complaining that your money was taken. What about the hardship your failure to pay has caused your children?

This is a law board and we stick to the law. Also there are lots of fathers that get default judgements against them and don't even know they have had children but are named as the father when the mothers get public assistance. Your attitude here seems a bit twisted and you have a chip on your shoulder. You need to stop with the comments like you've been posting in this section of the board.

    Thanks.

First, when posting a follow-up question or info, please use the Answer options at the bottom of the page rather than the Comments.

You really didn't answer Judy's question, so lets get this straight. Did you know that you had a child and that you were being required to pay support for it? If the answer to those questions is yes, then you have no recourse. They will not inform you that they are going to attach any assets, if they did give advance warning people would just move the assets.

But if you were not aware there was a support order in place and that you were behind on your support, then you may have a recourse. Frankly, though, if they were able to find your bank account, the odds are they knew where to serve you notice.
