    Termination of Florida lease
    We gave our landlord 60 days notice even though we will be terminating our lease early. We informed her we would be leaving March but would pay for the full amount even though we won't occupy the full month. We were served with papers today stating we have to pay for our last months rent (which we did when we first signed our lease; first last and security)in addition she was retaining our security because she doesn't have new renters. Can she with hold our security? She has had several applicants but for some reason chosen not to rent to them. The reason for our early termination is my husband got a civil service job at the pentagon isn't he covered under something like the soldier sailor act?

    You don't say how many months are left on the lease. She can sue you for all of them, regardless of how much notice you gave. I don't know about the sailors and soldiers act, but highly doubt that it covers a job, especially a civil service job. Such acts are meant for military assignments.

    Florida is one of the states whose law does not require the landlord to try and find a new tenant when the current tenant breaks their lease. The landlord can sue you for the entire remaining balance.

    Have you considered trying to find someone to take over the balance of your lease?
