    h1b taxes, first time, confused!
    Hey guys,

    I've been searching the internet and have hopefully found a resource that can help me.

    I'm a physician in Michigan who is here on an H1B visa. This was issued to me in July 2010 and since then, have been earning, living in Michigan. I'm single and from Canada.

    Before my visa was issued, I was living in Canada where I earned $0 for 2010, I was a student waiting to start my first job.

    I have tried going to a few of the local places with my work documents, but HnR and Jackson seem to think my issue is too complicated to file (I have not been able to successfully file my taxes yet).

    If anyone here has any insight as to what I'm supposed to do, or forms to file, or a site online (Turbo?), I'd greatly appreciate it.

    I have heard too much conflicting info and do not want to get an audit for using the wrong forms.

    If you did not complete 183 days in 2010 and you are single, you will file nonresident tax return Form 1040NR or 1040NR-EZ.
    This return can not be e-filed and Turbo tax will not do it. Download form from Internal Revenue Service and do it yourself.

    Thanks for the info.

    So to be exact, I calculated that I was issued my visa and was here for 183 days exactly.

    So do I have a choice between either the nr or ne-ez form?

    Next year, I will have been in the country for the entire year, will my tax filing forms be different once again?

    If you have spent 183 days, it makes your dual status.
    For 2011 you will file resident tax return.
