    Not if the nails are facing upwards where someone can step on them. The reason why is because it falls outside the realm of public safety.

    Yes, and if someone steps on the nails and gets injured, that someone can sue whoever put them there. Or perhaps have the perpetrator arrested for a crime. Depends.
