    Name omitted in Will
    Question from the state of KY. My father passed away before my grandmother made her Will. My grandmother listed her other three children in the Will. Should I have at least been mentioned in her Will (even if was that I take nothing under the terms of the Will)?

    No, she was under no obligation to mention children who pre-deceased her.

    Why would you have been mentioned if you were not included in the Will? The only time someone is specifically mentioned when they are not "given" anything is when they are SPECIFICALLY omitted, such as one child being omitted and another included.

    Why would you want your name included in the Will?

    OK just finished reading your post for the 3rd time and still can't figure out who you are in this story. From what I can tell you are a grand child but it appears no grand children where mentioned only her 3 children.

    Here's what I think. There were 4 children. OP's father was one of those children. OP's father is deceased. Now there are 3 living children, all mentioned in the Will. OP wants to know if living children of deceased children (she is the living child of a deceased father) should be mentioned in the Will, even though she did not inherit.

    Now I'm guessing that the estate was split among the 3 surviving children and OP wants to know if there was any requirement to "leave" anything to children of deceased children - her category.

    A Will does not list all survivors and beneficiaries and then list "0 to this one" and "10% to that one." It only lists the people who are left bequests.

    So - OP must wonder if she would be in line to inherit under State law.

    Otherwise... why would she be mentioned?

    OK, now I'm burned out.

    I think you have it and I actually see the OPs point if this is the situation. Like and entire branch of the family tree should not miss out on granny's will
