    No will for an estate
    My father passed away in march of 06. He resided in virginia beach, but owned a home in edenton North Carolina. He did not leave a will, but my brother and I were told by my father, that the house would be ours. Now there are complications! Can we get the house in our name without a will? If so How do we do that?

    Same as you would with a will, you make claim in probate court for the property, Then the who ever is the hier according to state law, will get ownership of the house.

    So if he was married, they will get the house normally.

    If he was not married, then his childrend ( all of them) would normally get equal ownership.

    But of course often if he had a lot of bills, the house may have to be sold to pay any and all bills first.
