    H4 Tutition tax credit
    Hi,

    I am in US on H1 for last 10 years. My wife has been studying in a community college (Associates degree) for last year. I file tax as married filing jointly. Can I claim the tution fees I paid for her as a tax deduction ?

    The college has refused to issue a 1098-T (saying that she does not have a SSN, but she does have a ITIN)

    Can I still claim the tax credit with the tution bills (but no 1098-T issued by the college).

    The college is being stupid. Yes, you CAN claim the credit. Just have proof that you paid the tuition in 2010, and you should have no problem.
