    F1 filed 1040, need help!
    I'm a F1 student came from Vietnam on Sep 2006. Last year, I came to a Tax income agent so that they can file my Tax income for me. I did not realize that they filed 1040 form which I was not suppose to file. I got some tax refund money.
    This year 2010, I don't know what to do. Should I file 1040X for 2009 and send them back the amount of money that I got? Please help me

    You need to file Forms 1040NR-EZ and 8843, plus the state tax return for 2010.

    You should then amend the 2009 return with Form 1040X, and attach a properly-prepared Form 1040NR-EZ and Form 8843 to the Form 1040X, repaying any tax that results from the amendment. On the Form 1040X, explain the error, ask to have your non-resident alien status reinstated, and ask for a waiver of all penalties and interest.
