    J1 - H1 B Visa and Taxes Issues
    Hi,

    Last October 2010 I transferred from a J1 Visa to a H1 B Visa. Whilst under a J1 Visa I was paying Social Security and Medicare which I believe I should not have been.

    I understand that under a H1 B Visa Laws I must pay medicare and social security.

    How do I therefore claim back Social Security and Medicare from my work period whilst on a J1 Visa.

    First, you must try to get the moneyh back from the employer. If successful, it is both EASIER and FASTER, AND the IRS requires that you try.

    If the employer refuses, get a refusal letter on company letterhead which specifies how much FICA (Social Security and Medicare) taxes were withheld while under the J-1 visa, then attach that letter (along with several other support forms) to a completed Form 843 and 8316 and mail it to the IRS.

    If you submit to the IRS, it will take 4-6 MONTHS to get your money back.
